Escrow
Vantage Escrow

Who Pays Escrow Fees in California?
Short answer: California law does not say who pays the escrow fee. In most of Southern California the buyer and seller usually split it, but custom varies from county to county, and the purchase contract has the final word. It can be negotiated before signing.
What the escrow fee covers
The escrow company is the neutral third party. It holds the buyer's funds and the seller's deed, checks each contract condition, and releases money and title at the same time once everything is met. The escrow fee pays for that service.
Title insurance, lender fees, recording fees and transfer taxes are separate line items on the closing statement.
Common practice
- Purchase: in most of Southern California the buyer and seller each pay their share. Custom in Northern California counties varies and the split may differ, so read the contract carefully on cross-region deals. If the contract checks "Both" with no other terms, the fee is split.
- Refinance and cash-out refinance: there is no seller, so the borrowing homeowner pays.
- All-cash purchase: split the same way as a financed purchase, per the contract.
Example: a $1,000,000 sale
Vantage Escrow charges $2.25 per $1,000 of the price plus $250 for purchase escrow. The buyer and the seller are each charged on this basis.
| Item | Buyer | Seller |
|---|---|---|
| Price | $1,000,000 | $1,000,000 |
| 1,000 × $2.25 | $2,250 | $2,250 |
| Base fee | $250 | $250 |
| Escrow fee | $2,500 | $2,500 (30% seller discount available) |
Refinance and cash-out escrow are a flat $750 regardless of loan amount. Commercial and 1031 exchange transactions are quoted case by case.
Three things to confirm before signing
- How the contract splits the escrow fee, and whether that matches what your agent told you.
- Which escrow company will handle the deal. California purchase contracts usually say which side chooses it.
- What other closing costs you will pay besides escrow. The escrow company can give you an estimate in advance.
